Major Acts done by the current National Government would be Unconstitutional under the de jure National Government. The current State Governments have not done anything to correct these Unconstitutional acts done by the current National Government which makes their actions de facto too. Major Unconstitutional Acts They may also be Unconstitutional in the government de facto but 'We the People' are not a party to the any of the government de factos.
How do we correct these actions by the governments de facto? The current government which is the "government of fact" has taken power away from the Lawful sovereigns inhabiting the sovereign Union States under a Plot 'exercising power and control' over all of us. The government de facto is defined in court cases and in Black's Law Dictionary, Sixth Edition page 697:
Government de facto. A government of fact. A government actually exercising power and control, as opposed to the true and lawful government; a government not established according to the constitution of the nation, or not lawfully entitled to recognition or supremacy, but which has nevertheless supplanted or displaced the government de jure. A government deemed unlawful, or deemed wrongful or unjust, which, nevertheless, receives presently habitual obedience from the bulk of the community.
In Black's Law Dictionary, SEVENTH EDITION page 703 -
De facto government. 1. A government that has taken over the regular government and exercises sovereignty over a nation. 2. An independent government established and exercised by a group of a country's inhabitants who have separated themselves from the parent state.
Everyone has to understand that Black's Law Dictionary is a dictionary created under the government de facto and cannot be trusted but when they define words or terms we can use those definitions against them.
What happened is simple to explain but hard to understand that it did happen. A 'group of inhabitants of each Union state sometime in the 1860s separated themselves from the parent state and created state government de facto within each of the Union States and the de facto is still the government de facto today.
The actions by any groups of inhabitants of any of the Union state did not have the delegated authority to'supplanted or displaced the government de jure'.

Boasberg in his Memorandum Opinion under " B " PRECEDENT, stated; "Defendant ( ARMY BCMR ) first responds that the ABCMR is not bound by precedent because it is a board of equity. Defendant has not cited a single case in support of this novel legal argument ". Moreover, " it is axiomatic that an agency must treat similar cases in a similar manner unless it can provide a legitimate reason for failing to do so ". KREISS III, 406 F.3d at 687
